Bio Magazine Advertising Terms of Service
These Terms of Service (“Terms”) govern your purchase of a Bio Magazine advertising feature (“Feature”) from Bio Magazine / WebPros Media (“Publisher,” “Bio,” “we,” “us”). By purchasing a Feature through our online checkout and accepting these Terms, you (“Client,” “Advertiser,” “you”) agree to the following:
1) Feature Purchase + Deliverables
Your purchase reserves a Feature in Bio Magazine, along with the package you choose (at checkout or on your onboarding call after checkout). Deliverables (page count, photo count, digital inclusions, etc.) are based on the package/product description and any written add-ons confirmed by Publisher.
The Publisher does retain the right to refuse the feature purchase of any Advertiser, whether before or after the Advertiser has purchased their feature.
2) $500 Deposit (Non-Refundable)
At checkout, you will pay a $500 deposit to reserve production and a Feature slot. The $500 deposit is non-refundable, including cancellation, no-shows, non-participation, business closure, delays, or failure to provide required information.
An exception will be made by the Publisher if they refuse to allow the Client to be featured. In this case, the $500 deposit will be refunded.
3) Remaining Balance + Invoicing
The remaining balance of your feature will be billed via invoice. If you request multiple payments, we may split invoices accordingly if approved by us. Balances must be paid by the invoice due date(s). Late payment may delay or prevent photography, proof delivery, and/or your publication feature.
4) Client Cooperation + Intake Requirements
You agree to participate in our intake process and provide accurate information, approvals, and scheduling cooperation in a timely manner. If you do not, Publisher may proceed using available information, reschedule to a later issue (if available), or treat the Feature as cancelled (deposit remains non-refundable).
5) Photography + Scheduling
Photography is scheduled based on availability and production timelines. Missed sessions or late reschedules may result in delays and/or additional fees.
6) Proofs, Revisions, and Editorial Control
We provide proofs for review. You may request reasonable factual corrections and any other recommended changes. Publisher retains final editorial and design control (including layout, photo selection, story structure, and style). If you do not respond by a stated deadline, proofs may be deemed approved by us.
7) Rights: Photos + Use of Materials
Publisher owns all Bio session photos and creative work. Any usage rights provided to Client are limited to what is included in the purchased package (unless otherwise agreed in writing). Additional photos may be purchased at an agreed cost. You grant Publisher permission to use your name, logo, and Feature content for producing and promoting the Feature and Bio Magazine in print and digital formats.
8) Cancellations + No Refunds
You may request cancellation in writing; however:
the $500 deposit is non-refundable, and
if production (writing, design, or photography) has started or publication space has been reserved, Client may still be responsible for amounts due or incurred.
9) Liability Limits + Indemnification
To the maximum extent allowed by law, Publisher is not liable for indirect or consequential damages, and total liability is limited to the amount paid by Client for the Feature. Client agrees to indemnify Publisher for claims arising from Client-provided content/materials or Client’s breach of these Terms.
10) Publication Changes + Force Majeure
Publication schedules, placement, and distribution may change. Publisher is not responsible for delays or failure caused by events beyond reasonable control.
11) Governing Law
These Terms are governed by the laws of the State of Wyoming, and any disputes will be handled in Wyoming courts unless otherwise required by law.
